This paper analyses how the civil and ecclesiastical hierarchies shared their responsibilities over marriage and the roles played by the experts of the Church and by those of the State. The princes and the secular authorities did not exercise an exclusive control over the marriages because in the orthodox tradition, the domain of the private life was under the control of the Church. This article presents the marriage in the Rumanian legal system, since the Romano-Byzantine laws towards legislation more recent and more adapted to the realities and it distinguishes the impediments to the marriage (diriment impediment and prohibitive impediment) as well as the conditions for the dissolution of marriage.
